From 1 July 2009 the unfair dismissal threshold for small business will change, but it will change again on 1 January 2011.

All businesses will be able to dismiss an employee within the first six months of employment without facing an unfair dismissal case.

However, small businesses will be able to avoid the unfair dismissal jurisdiction for twelve months rather than six months.

Until 1 January 2011, a small business will be defined as one employing fewer than fifteen full time equivalent employees. After that date, the definition will change to fifteen employees using a simple headcount.
